TV watchdog Ofcom has cleared Dannii Minogue of making "homophobic" remarks about X Factor contestant Danyl Johnson. The Aussie singer commented about Johnson's performance of the song `And I'm Telling You I'm Not Going', which was originally composed as a female lead vocal.
Dannii said: "If we're to believe everything we read in the papers, maybe you didn't need to change the gender reference in it?"
Simon Cowell slammed Dannii for making the remarks and she issued an apology to Danyl, saying: "They were only said with humour."
Ofcom said that almost 4,000 viewers contacted them to complain over Dannii's comments.
The watchdog said that the majority of complaints were concerned that Dannii was being "homophobic" and "malicious".
Danyl said at the time that he "was not offended" by the judge's comments.
Ofcom said: "In Ofcom's view, it was not outside the established nature of the programme for an X Factor judge to make such a comment as Dannii Minogue's especially in circumstances where the performer had placed information about his sexuality in the public domain.
"Ofcom did not discern a pejorative or homophobic intent behind her comment."
