A retrial has been ordered for an appeals court case in Sweden after the judge reportedly fell asleep.

According to the defence and prosecuting teams at the Gothenburg trial, the judge took a nap, but he has dismissed such claims.

Prosecutor Margareta Esplund told TV4: "It is a very important aspect of the legal process that the person trying the district court decision is present.

"Normally when a person falls asleep there are certain indications of this - you start by closing your eyes and then the head falls forward, followed by jerking movements as you pull yourself together."

But the judge claims his non-involvement was because of a conflict of interests rather than sleep.
